Admitted Sun Sea crew member should be jailed until deportation decision: CBSA

The Canadian Press VANCOUVER - A federal lawyer says a Tamil refugee claimant alleged to be part of the human smuggling operation that brought hundreds of migrants to Canadian shores should be kept in custody until he learns whether he'll be deported.


The man, who can't be identified, was among 492 men, women and children who arrived on the MV Sun Sea last August, immediately making refugee claims.

The Immigration and Refugee Board has heard the man admitted he was one of 12 crew members who helped run the ship on its voyage from Thailand to Canada.
A lawyer for the Canada Border Services Agency, Kenny Nicolaou, says the man poses a flight risk.

He says the man has no strong ties to Canada, and proved himself untrustworthy because he initially lied to border officials about his connection to the ship.
The man's lawyer, Roland Luo, says his client will have a number of legal options even if he's ordered deported, giving him an incentive to stay if he ever wants to stay in Canada.
